1. Acceptance of Terms
By using Gainzilla (“Service”), including scanning a station QR and starting a set, you agree to these Terms. If you do not agree, do not use the Service.
2. Pilot/Beta Notice
The Service (including “Gainzilla Coach”) is in beta. Features may be incomplete or change without notice. You accept the risks of pre-release software.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction).
4. Gym Installations & Video Processing
When used in a gym, the Service may process live camera streams to analyze barbell movement. We process video frames to extract motion signals and metrics. For MVP installations, we do not store raw video by default unless the gym or Gainzilla enables it for QA or safety review. When stored, retention is short and limited to operational needs. We do not create biometric identifiers.
5. Roles & Data Sharing
(a) Gainzilla operates the analytics platform.
(b) The gym (“Gym Operator”) provides camera access and may access metrics and set summaries for operational purposes.
By using a gym station, you authorize Gainzilla to process set data and share your set metrics (and optional name) with the Gym Operator for legitimate interests (e.g., equipment usage, member support). See our Privacy Policy for details.
6. Safety & Medical Disclaimer
Gainzilla is not a medical device and does not provide medical advice. Content is educational and general. Always consult a qualified professional before changing your exercise program, especially if you have any condition or injury. Use a spotter for heavy attempts.
7. Assumption of Risk; Release
Strength training involves inherent risks, including serious injury. You voluntarily assume all risks of your training. To the fullest extent permitted by law, you release Gainzilla and its personnel from claims arising out of your training and use of the Service.
8. No Professional Coaching Relationship
Use of the Service does not create a coach–client or clinician–patient relationship. You are responsible for evaluating any guidance.
9. Accounts, Conduct & Station Use
Do not misuse the Service (e.g., unlawful content, harassment, reverse engineering, bypassing security). Do not obstruct the camera or intentionally attempt to confuse the system. The Gym Operator may set site-specific rules.
10. User Content & License
If you submit content (e.g., name, feedback), you grant Gainzilla a worldwide, royalty-free license to host, process, display, and use it to operate and improve the Service, consistent with our Privacy Policy.
11. AI/Third-Party Providers
We may send prompts and metadata to third-party providers (e.g., model/hosting/database vendors) to deliver features. Do not submit sensitive personal data.
12. Privacy & Retention
We collect minimal data needed for set analysis (e.g., station ID, time, metrics, optional name). Raw video is not stored by default in MVP; if enabled, retention is short and access is restricted. You may request deletion of your set data where applicable by law by contacting us (include gym, date/time, and station).
13. Intellectual Property
The Service and its content are owned by Gainzilla or its licensors. No rights are granted except as expressly set forth.
14. Changes to the Service
We may modify, suspend, or discontinue features at any time.
15. Warranty Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAINZILLA DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAINZILLA AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF US$100 OR AMOUNTS YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM.
17. Indemnification
You agree to indemnify and hold Gainzilla harmless from claims arising from your use of the Service or violation of these Terms.
18. Termination
We may suspend or terminate your access at any time. On termination, your right to use the Service ceases immediately.
19. Governing Law & Venue
These Terms are governed by the laws of Israel. Exclusive jurisdiction lies with the competent courts in Tel Aviv–Jaffa.
20. Changes to Terms
We may update these Terms. Material changes will be posted with an updated “Last updated” date. Continued use after changes constitutes acceptance.

3. כשירות

4. התקנות בחדר כושר ועיבוד וידאו
בעת שימוש בחדר כושר, השירות עשוי לעבד שידורי מצלמה חיים כדי לנתח את תנועת המוט. אנו מעבדים פריימים של וידאו כדי לחלץ אותות תנועה ומדדים. בהתקנות MVP, איננו שומרים וידאו גולמי כברירת מחדל אלא אם חדר הכושר או Gainzilla מפעילים זאת לצורכי בקרת איכות או בדיקת בטיחות. כאשר נשמר, תקופת השמירה קצרה ומוגבלת לצרכים תפעוליים. איננו יוצרים מזהים ביומטריים.
5. תפקידים ושיתוף נתונים
(א) Gainzilla מפעילה את פלטפורמת הניתוח.
(ב) חדר הכושר (״מפעיל חדר הכושר״) מספק גישה למצלמות ועשוי לגשת למדדים ולסיכומי סטים למטרות תפעוליות.
בשימוש בעמדת חדר כושר, אתה מאשר ל‑Gainzilla לעבד נתוני סט ולשתף את מדדי הסט שלך (ושם אופציונלי) עם מפעיל חדר הכושר לאינטרסים לגיטימיים (למשל, שימוש בציוד, תמיכה במתאמנים). ראה את מדיניות הפרטיות שלנו לפרטים.
6. בטיחות ומידע רפואי
Gainzilla אינו מכשיר רפואי ואינו מספק ייעוץ רפואי. התוכן הוא חינוכי וכללי. התייעץ תמיד עם איש מקצוע מוסמך לפני שינוי תוכנית האימונים שלך, במיוחד אם יש לך מצב רפואי או פציעה. השתמש בשומר (ספוטר) לניסיונות כבדים.
7. נטילת סיכון; ויתור

9. חשבונות, התנהגות ושימוש בעמדה
אל תעשה שימוש לרעה בשירות (למשל, תוכן בלתי חוקי, הטרדה, הנדסה לאחור, עקיפת אבטחה). אל תסתיר את המצלמה ואל תנסה בכוונה לבלבל את המערכת. מפעיל חדר הכושר רשאי לקבוע כללים ספציפיים לאתר.
10. תוכן משתמש ורישיון
אם תגיש תוכן (למשל, שם, משוב), אתה מעניק ל‑Gainzilla רישיון עולמי, ללא תמלוגים, לארח, לעבד, להציג ולהשתמש בו להפעלה ולשיפור השירות, בהתאם למדיניות הפרטיות שלנו.
11. ספקי AI/צד שלישי
אנו עשויים לשלוח הנחיות (prompts) ומטא‑נתונים לספקי צד שלישי (למשל, ספקי מודלים/אחסון/מסדי נתונים) כדי לספק תכונות. אל תגיש מידע אישי רגיש.
12. פרטיות ושמירת נתונים
אנו אוספים את המינימום הנדרש לניתוח סטים (למשל, מזהה עמדה, זמן, מדדים, שם אופציונלי). וידאו גולמי אינו נשמר כברירת מחדל ב‑MVP; אם מופעל, תקופת השמירה קצרה והגישה מוגבלת. תוכל לבקש מחיקה של נתוני הסט שלך כאשר הדבר חל על פי חוק, על ידי פנייה אלינו (כלול חדר כושר, תאריך/שעה ועמדה).
13. קניין רוחני
השירות ותכניו הם בבעלות Gainzilla או נותני הרישיון שלה. לא ניתנות זכויות למעט כפי שנקבע במפורש.
14. שינויים בשירות
אנו רשאים לשנות, להשעות או להפסיק תכונות בכל עת.
15. כתב ויתור על אחריות
השירות מסופק ״כפי שהוא״ ו״כפי שזמין״. במידה המרבית המותרת בחוק, Gainzilla מתנערת מכל אחריות, לרבות סחירות, התאמה למטרה מסוימת ואי‑הפרה.
16. הגבלת אחריות
במידה המרבית המותרת בחוק, Gainzilla והחברות הקשורות לה לא יישאו באחריות לנזקים עקיפים, מקריים, מיוחדים, תוצאתיים, לדוגמה או עונשיים, או לאובדן רווחים, נתונים או מוניטין. האחריות הכוללת שלנו לא תעלה על הגבוה מבין 100 דולר ארה״ב או הסכומים ששילמת ב‑12 החודשים שלפני התביעה.
17. שיפוי
אתה מסכים לשפות ולהגן על Gainzilla מפני תביעות הנובעות מהשימוש שלך בשירות או מהפרת תנאים אלה.
18. סיום
אנו רשאים להשעות או לסיים את גישתך בכל עת. עם הסיום, זכותך להשתמש בשירות פוקעת מיידית.
19. דין חל וסמכות שיפוט
תנאים אלה כפופים לחוקי מדינת ישראל. סמכות השיפוט הבלעדית נתונה לבתי המשפט המוסמכים בתל אביב–יפו.
20. שינויים בתנאים
אנו רשאים לעדכן תנאים אלה. שינויים מהותיים יפורסמו עם תאריך ״עודכן לאחרונה״ מעודכן. המשך השימוש לאחר שינויים מהווה הסכמה.
